Background Most jurisdictions that allow euthanasia and assisted suicide (AS) regulate it through the medical profession. However, the extent and nature of how medicine should be involved are debated. Swiss AS practice is unusual in that it is managed by lay AS organizations that rely on a law that permits AS when done for nonselfish reasons. Physicians are not mentioned in the law but are usually called upon to prescribe the lethal medications and perform capacity evaluations.Methods We analyzed in-depth interviews (...) of 23 Swiss AS experts including ethicists, lawyers, medical practitioners, and senior officials of AS organizations for their views on AS.Results Although there was agreement on some issues (e.g., need for better end-of-life care), the interviewees’ preferred model for AS, and the nature of preferred medical involvement, varied, which we categorized into five types: preference for AS practice as it occurred prior to lay AS organizations; preference for the current lay model; preference for a modified lay model to increase autonomy protections while limiting medical AS normalization; preference for various types of more medicalized models of AS; and, ambivalence about any specific model of medical involvement. The rationales given for each type of model reflected varying opinions on how medicine’s role would likely impact AS practice and demonstrated the experts’ attitudes toward those impacts.Conclusion The dynamics within the Swiss AS regime, as reflected in the varying views of Swiss AS experts, shed light on the dilemmas inherent to medical scope and involvement in AS, which may have implications for debates in other jurisdictions. ABSTRACT The essay is concerned with the widely held view that contemporary fine art is obscurantist, shallow and unrewarding of attention. It is argued that the opposition between common opinion and the advocates of modernism rests upon a philosophical disagreement about the nature and value of art. An account of aesthetic experience is then presented and illustrated by reference to Raphael's The School of Athens. This account shows the reasoning implicit in modernism to rest upon a fallacy relating to the (...) possible forms of explanation. The essay concludes by endorsing Augustine's claim that culcural intelligibility rests not on abstract reasoning but on shared affections. This sets a requirement for artists to return to making work that engages the interests of their fellow citizens. (shrink)

Cet article propose de retracer dans l’œuvre de Foucault la présence d’un engagement critique discret mais continu avec la catégorie aristotélicienne de la phronesis. Au cours des années 1970, Foucault consacre ses recherches à de nombreuses instances de la techné, savoir pratique proche mais distinct de la phronesis. S’il ne mentionne pratiquement pas cette dernière, nous montrerons cependant que ce non-dit est tout sauf un impensé. C’est par un travail de et sur la phronesis que Foucault pensera la complexité des (...) savoirs pratiques et négociera la distinction entre sa propre méthode, dite « généalogique », et les méthodes qu’il prend pour objet. Nous verrons que cette distinction s’articule autour d’un second doublet, celui du cas et de la singularité – une distinction qui prend tout son sens lorsqu’elle est passée au crible de la triade aristotélicienne du savoir : épistémè, techné et phronesis. Nous verrons que la notion foucaldienne de singularité, loin d’être identique au cas particulier, en constitue plutôt le principe de différence interne. En substituant une herméneutique de la singularité à une herméneutique du particulier, Foucault s’autorise à penser une phronesis renouvelée pour les temps présents. (shrink)

Mitochondrial/nuclear transfer (M/NT) to avoid the transmission of serious mitochondrial disease raises complex and challenging ethical, legal and social issues (ELSI). In February 2015, the United Kingdom became the first country in the world to legalize M/NT, making the heated debate surrounding this technology even more relevant. This critical interpretive review identified 95 relevant papers discussing the ELSI of M/NT, including original research articles, government-commissioned reports, editorials, letters to editors and research news. The review presents and synthesizes the arguments present (...) in the literature in relation to the most commonly raised themes: terminology; identity, relationships and parenthood; potential harm; reproductive autonomy; available alternatives; consent; impact on specific interest groups; resources; “slippery slope”; creation, use and destruction of human embryos; and beneficence. The review concludes by identifying those ELSI that are specific to M/NT and by calling for follow-up longitudinal clinical and psychosocial research in order to equip future ELSI debate with empirical evidence. Positive emotions are highly valued and frequently sought. Beyond just being pleasant, however, positive emotions may also lead to long-term benefits in important domains, including work, physical health, and interpersonal relationships. Research thus far has focused on the broader functions of positive emotions. According to the broaden-and-build theory, positive emotions expand people’s thought–action repertoires and allow them to build psychological, intellectual, and social resources. New evidence suggests that positive emotions—particularly gratitude—may also play a role in motivating individuals to engage in (...) positive behaviors leading to self-improvement. We propose and offer supportive evidence that expressing gratitude leads people to muster effort to improve themselves via increases in connectedness, elevation, humility, and specific negative states including indebtedness. Academics across widely ranging disciplines all pursue knowledge, but they do so using vastly different methods. Do these academics therefore also have different ideas about when someone possesses knowledge? Recent experimental findings suggest that intuitions about when individuals have knowledge may vary across groups; in particular, the concept of knowledge espoused by the discipline of philosophy may not align with the concept held by laypeople. Across two studies, we investigate the concept of knowledge held by academics across seven disciplines (N (...) = 1,581) and compare these judgments to those of philosophers (N = 204) and laypeople (N = 336). We find that academics and laypeople share a similar concept of knowledge, while philosophers have a substantially different concept. These experiments show that (a) in contrast to philosophers, other academics and laypeople attribute knowledge to others in some “Gettier” situations; (b) academics and laypeople are much less likely to attribute knowledge when reminded of the possibility of error, but philosophers are not affected by this reminder; and (c) non‐philosophy academics are overall more skeptical about knowledge than laypeople or philosophers. These findings suggest that academics across a wide range of disciplines share a similar concept of knowledge, and that this concept aligns closely with the intuitions held by laypeople, and differs considerably from the concept of knowledge described in the philosophical literature, as well as the epistemic intuitions of philosophers themselves. The rise of the phenomenon of virtue ethics in recent years has increased at a rapid pace. Such an explosion carries with it a number of great possibilities, as well as risks. This volume has been written to contribute a multi-faceted perspective to the current conversation about virtue. Among many other thought-provoking questions, the collection addresses the following: What are the virtues, and how are they enumerated? What are the internal problems among ethicists, and what are the objections and replies (...) to contemporary virtue ethics? This book provides an introduction to the emerging field of Continental philosophy of religion by treating the philosophical thought of its most important representatives, including its appropriations by several thinkers in the US. Part I provides a context to the field by looking at the religious aspects of the thought of Martin Heidegger, Emmanuel Lévinas, and Jacques Derrida. It contends that although the work of these thinkers is not apologetic in nature, it prepares the ground for the more religiously motivated (...) work of more recent thinkers by giving religious language and ideas some legitimacy in philosophical discussions. Part II devotes a chapter to each of the contemporary French thinkers who articulate a phenomenology of religious experience: Paul Ricoeur, Jean-Luc Marion, Michel Henry, Jean-Louis Chrétien, Jean-Yves Lacoste and Emmanuel Falque. This part argues that their respective philosophies can be read as an apologetics of sort, namely as making arguments for the coherence of thought about God and the viability of religious experience, though each does so in a different fashion and to a different degree. Part III considers the three major thinkers who have popularized and extended this phenomenology in the US context: Merold Westphal, John D. Caputo, and Richard Kearney. The book thus both provides an introduction to important contemporary thinkers many of whom have not yet received much treatment in English and also argues that their philosophies can be read as providing an argument for Christian faith. Effectiveness is a key criterion in assessing the justification of antibiotic resistance interventions. Depending on an intervention’s effectiveness, burdens and costs will be more or less justified, which is especially important for large scale population-level interventions with high running costs and pronounced risks to individuals in terms of wellbeing, integrity and autonomy. In this paper, we assess the case of routine hospital screening for multi-drug-resistant Gram-negative bacteria (MDRGN) from this perspective. Utilizing a comparison to screening programs for Methicillin-Resistant Staphylococcus aureus (...) (MRSA) we argue that current screening programmes for MDRGN in low endemic settings should be reconsidered, as its effectiveness is in doubt, while general downsides to screening programs remain. To accomplish justifiable antibiotic stewardship, MDRGN screening should not be viewed as a separate measure, but rather as part of a comprehensive approach. The program should be redesigned to focus on those at risk of developing symptomatic infections with MDRGN rather than merely detecting those colonised. (shrink)

The phenomenon and implications of stigma have been recognized across many contexts and in relation to many discrete issues or conditions. The notion of spatial stigma has been developed within stigma literature, although the importance and relevance of spatial stigma for rural places and rural people have been largely neglected. This is the case even within fields of inquiry like public and rural health, which are expansively tasked with addressing the socio-structural drivers of health inequalities. In this paper, we argue (...) that developing a better understanding of rural place stigma is critical for addressing contemporary patterns of spatial injustice and health inequalities affecting rural communities globally. Drawing on international literature and examples from the reported experiences of rurally living Australians and news and other media, we present an analysis highlighting the power in rural place stigma. In doing so, we build a case for the relevance and importance of interrogating rural place stigma, especially in the fields of public and rural health, for changing the conditions within—and the broader positioning of—the rural in the public and political landscapes. This book is a comprehensive study of the writings of Jean-Paul Sartre. As well as examining the drama and the fiction, the book analyses the evolution of his philosophy, explores his concern with ethics, psychoanalysis, literary theory, biography and autobiography and includes a lengthy section on the still much-neglected study of Flaubert, L'Idiot de la famille. One important aim of the book is to rebut the charges made by many theorists and philosophers by revealing that Sartre is in fact a (...) major source for concepts such as the decentred subject and detotalised truth and for the revolt against individualistic humanism. Dr Howells also takes into account much posthumously published material, in particular the Chaiers pour une morale, but also the Lettres au Castor and the Cranets de la drole de guerre. The work is a substantial contribution to Sartre studies, but has been written with the non-specialist in mind; to that end all quotations are translated into English and gathered in an appendix. This paper aims to provide a fresh historical perspective on the debates on vitalism and holism in Germany by analyzing the work of the zoologist Hans Spemann (1869–1941) in the interwar period. Following up previous historical studies, it takes the controversial question about Spemann’s affinity to vitalistic approaches as a starting point. The focus is on Spemann’s holistic research style, and on the shifting meanings of Spemann’s concept of an organizer. It is argued that the organizer concept unfolded multiple layers (...) of meanings (biological, philosophical, and popular) during the 1920s and early 1930s. A detailed analysis of the metaphorical dynamics in Spemann’s writings sheds light on the subtle vitalistic connotations of his experimental work. How Spemann’s work was received by contemporary scientists and philosophers is analyzed briefly, and Spemann’s holism is explored in the broader historical context of the various issues about reductionism and holism and related methodological questions that were so prominently discussed not only in Germany in the 1920s. This is one of the most comprehensive and up-to-date surveys of the philosophy of Sartre, by some of the foremost interpreters in the United States and Europe. The essays are both expository and original, and cover Sartre's writings on ontology, phenomenology, psychology, ethics, and aesthetics, as well as his work on history, commitment, and progress; a final section considers Sartre's relationship to structuralism and deconstruction. Providing a balanced view of Sartre's philosophy and situating it in relation to contemporary trends in (...) Continental philosophy, the volume shows that many of the topics associated with Lacan, Foucault, Levi-Strauss, and Derrida are to be found in the work of Sartre, in some cases as early as 1936. A special feature of the volume is the treatment of the recently published and hitherto little studied posthumous works. (shrink)

This article explores the collaborative research of the Nobel laureate Hans Spemann (1869–1941) and the Swiss zoologist Fritz Baltzer (1884–1974) on problems at the intersection of development and heredity and raises more general questions concerning science and politics in Germany in the interwar period. It argues that Spemann and Baltzer’s collaborative work made a significant contribution to the then ongoing debates about the relation between developmental physiology and hereditary studies, although Spemann distanced himself from _Drosophila_ genetics because of his anti-reductionist (...) position. The article analyzes how Spemann framed the issues of heredity in terms of an epigenetic principle in the context of his work on the “organizer,” and it explores the experimental dynamics of research on newt merogones carried out by Baltzer in a methodological development of Spemann’s constriction experiments. Finally, these research attempts are discussed as part of a broader “prehistory” of the mid-twentieth century cell nuclear transplantation experiments, which provided the basis for later animal cloning. This article adds to contemporary analyses of neoliberalism by shedding light on its psychic life. Writers in the Foucauldian tradition have explored how subjectivities are reconstituted under neoliberalism, showing that the neoliberal self is an entrepreneurial subject. Yet, there has been little empirical research that explores entrepreneurial subjectivity and, more specifically, its psychic life. By drawing on over 60 in-depth interviews with individuals who may be entrepreneurial subjects par excellence, this article adds to our understanding of how neoliberalism is lived (...) out. The article is divided into 10 sections, with each section exploring a distinct contour of entrepreneurial subjectivity. They show, for example, that competition is not only other-directed under neoliberalism, but also directed at the self, and that exclusionary processes lie at the heart of the constitution of entrepreneurial subjectivities. By providing a theoretically informed analysis of a wealth of empirical data, the article makes an original contribution to our understanding of the psychic life of neoliberalism. (shrink)

This paper argues that advertisements have been wrongly conceived as appealing to the irrational. Advertisements contain a structure of argumentation, but often far more complex than would initially appear. Advertisements give reasons for consumers to choose products, voters to elect a candidate, or citizens to alter their behavior. The way they do so is to best explained in terms of their argumentative structure.

In several lectures, interviews and essays from the early 1980s, Michel Foucault startlingly argues that he is engaged in a kind of critical work that is similar to that of Immanuel Kant. Given Foucault's criticisms of Kantian and Enlightenment emphases on universal truths and values, his declaration that his work is Kantian seems paradoxical. I agree with some commentators who argue that this is a way for Foucault to publicly acknowledge to his critics that he is not, as some of (...) them charge, attempting a total critique of Enlightenment beliefs and values, but is instead attempting to transform them from within. I argue further that Foucault's self-professed Kantianism can also productively be read as a means of encouraging change in his intellectual audience, a call to courage to take up the thread of Enlightenment thought that Foucault finds in Kant's essay, `What is Enlightenment?': that of directing one's philosophical efforts towards questioning and transforming one's own present in its historical specificity, for the sake of promoting the values of freedom and autonomy therein. Though much of Kant's philosophical work is focused on that which lies outside of history, Foucault locates in some of it a concern for what is happening here and now that, I argue, he encourages his audience to take up for themselves through tracing his own intellectual lineage to Kant. In so doing, he encourages contemporary philosophers to consider the value and effects of their work on the present social and political contexts in which they live. (shrink)

In this paper we investigate compassion and its place within mindfulness-based approaches. Compassion is an orientation of mind that recognizes pain and the universality of pain in human experience and the capacity to meet that pain with kindness, empathy, equanimity and patience. We outline how learning to meet pain with compassion is part of how people come to live with chronic conditions like recurrent depression. While most mindfulness-based approaches do not explicitly teach compassion, we describe how the structure of the (...) programme and teachers' embodiment enable participants to cultivate compassion in the landscape of suffering. We describe a case example of how this process unfolded for someone through mindfulness-based cognitive therapy. (shrink)

The role of the major histocompatibility complex (MHC) in mate choice in humans is controversial. Nowadays, the availability of genetic variation data at genomic scales allows for a careful assessment of this question. In 2008, Chaix et al. reported evidence for MHC‐dependent mate choice among European American spouses from the HapMap 2 dataset. Recently, Derti et al. suggested that this observation was not robust. Furthermore, when Derti et al. applied similar analyses to the HapMap 3 European American samples, they did (...) not see a significant effect. Although some of the points raised by Derti et al. are relevant, we disagree with the reported absence of evidence for MHC‐dependent mate choice within the HapMap samples. More precisely, we show here that the MHC dissimilarity among HapMap 3 European American spouses is still extreme in comparison to the rest of the genome, even after multiple testing correction. This finding supports the hypothesis of MHC‐dependent mate choice in some human populations. (shrink)

Offender populations experience their incarceration through different lenses and often as a spiritual journey of suffering. During 2017 and 2018 a study was conducted by the authors with 30 men serving long-term sentences in Correctional Centre A, Zonderwater Management Area in the Gauteng province of South Africa. Following interviews and focus group sessions, the authors report on participants’ representations on how their constructed views of God assist them to find meaning in suffering while incarcerated. Narrative inquiry as a philosophical framework (...) was applied, which presupposes equality between the researcher and the participant, the unmediated representation of words as data, the researcher as auto-ethnographer and respectful submission to subjectivity. Participants’ views of God are thematised according to sets of God-images, firstly, as identified by Van der Ven in his book God Reinvented?, adapted by the authors to suit the contents of the participants’ God talk. Secondly, the ‘God-images in Africa’ were applied. The participants’ constructed God-images are divided into two categories: images that feed on the binary between divine and human and images that function in the dialogical spaces between divine and human where the incarcerated have internalised an external God. Binary images of God are presented by the apathetic God, retributive God, controlling God and the purifying God. However, a significant number of participants expressed their belief in God through the dialogical image of the compassionate God, and the suffering God as co-sufferer. The role of Africanness in constructing these God-images constitutes a special point of inquiry in this article, as reflected in the images of God defined by God the Great Ancestor and Divine Spirit, and God with whom a mystical union is formed. <b>Objectives:</b> To gather empirical data on how gender and educational level influence bioethical reasoning among medical students by analyzing their use of care versus justice arguments for reconciling a bioethical dilemma. <b>Setting:</b> University Departments of Medical Ethics, Social and Communication Psychology in Germany. Participants: First and fifth year medical students. Design and method: Multidisciplinary, empirical, 2-segment study of ethics in action: In intrapersonal Segment 1, the students were presented with a bioethical dilemma and then administered a 13-item questionnaire to survey (...) their individual preferences for care versus justice arguments in resolving the conflict. The survey questioned 6 justice, 6 care-related items and 1 socially critical item. Data were analysed by gender and year of medical school. In interpersonal Segment 2, the bioethical dilemma from Segment 1 was discussed in gender-mixed and gender-homogeneous groups. Coded transcripts were evaluated to identify prevalences in care versus justice reasoning. <b>Results:</b> Data on 462 medical students were evaluable (n=338 in Segment 1, n=168 in Segment 2, n=44 overlap). Gender and level of education had no effect on moral reasoning in intrapersonal Segment 1, but significantly affected reasoning in interpersonal Segment 2, where women significantly tended to use more care-orientated arguments. Justice arguments predominated the group discussions. <b>Conclusion:</b> Interpersonal contexts affect moral reasoning in medical students, probably by amplifying the socialisation relating to gender and educational level. Care orientation is associated with the female gender. Professional socialisation tends to reduce the diversity and richness of moral reasoning towards a more justice-weighted orientation. Medical ethics should teach both justice and care reasoning modes in order to broaden physicians' ability to reconcile bioethical dilemmas. (shrink)

In the Bhagavad-Gita, Krishna lays out three paths of yoga as the means to achieve human perfection: the path of self-less action, the path of knowledge, and the path of devotion. In this paper I will argue for an interpretation of the Gita in which the path of devotion is the last step that leads to moksha. This is not to claim that bhakti yoga is more important than karma and jnana yoga, but rather that the latter two are more (...) elementary. In order to practice bhakti yoga, one must first have practiced karma and jnana yoga. All three forms of yoga are equally important—but there is a prioritized order in which they are to be practiced. On my reading, bhakti is more than having an intense feeling of love for God, because practicing devotion to God is an intellectual love of God that entails an intuitive understanding of the essence of things. My approach is to cross-examine the concept of human perfection as discussed in the Gita and Spinoza’s Ethics. Human perfection is characterized in both texts as a total liberation from being guided by things external to oneself other than one’s own nature. In other words, the aim of life is to liberate oneself by acquiring the right kind of knowledge. The freer one becomes and the more knowledge that one has, the more perfect one becomes. Thus, Spinoza’s idea of the “free man” resembles the self-realized agent in the Gita, because a human being becomes more “perfect” when he expresses God’s power to a greater degree. Bhakti yoga is the last step on the path to attain knowledge of God because in bhakti yoga, one employs the method of intuition to grasp God’s essence. As such, unlike karma and jnana yoga, the knowledge acquired in bhakti yoga is not empirical. In the Gita, rational devotion is a single act of both the mind and the heart, which, in turn, will lead to the practice of self-less actions. (shrink)

The ability of nurses to act as moral agents in accordance with their conscience is both an essential human freedom and an important part of professional ethics. Recent developments in Canada related to Medical Assistance in Dying have revealed new and important challenges related to conscientious objection – challenges that may require rethinking of how nurses do professional ethics. Notably, the inclusion of a personalist bioethical approach is needed to introduce and explicate what conscience is for nurses to be able (...) to apply it to nursing practice. In this article, we explore the importance of conscience and conscientious objection as ethical concepts to support nurses in addressing issues of conscience amid ethically challenging situations. We discuss how a personalist basis for conscience can support nurses to inclusively engage with one another across diverse moral perspectives. (shrink)

This paper employs Ricoeur’s hermeneutic approach to examine how fundamentalist religious communities shape personal and social identity. His biblical hermeneutics is used to analyze how narrative texts of various genres open a ‘fundamentalist’ world, while also challenging his monolithic emphasis on written texts. I argue that a wider variety of texts as well as rituals and other media must be examined, which all inform and display the fundamentalist world in important ways. Second, I employ his analysis of the formation of (...) identity and action to understand how identity is framed and prescribed by fundamentalist communities for their members. Finally, I draw on Ricoeur’s account of symbolism and move from first to second naïveté to provide an account of how fundamentalist communities respond to modernity and the threat of Enlightenment rationality. I argue that, contra what Ricoeur proposes, earlier mythic language was highly polyphonic and not understood literally. Fundamentalist communities move to more literalist understandings in response to modernity. Thus, while Ricoeur’s hermeneutic approach is richly useful for a philosophical approach to religious fundamentalism, the close examination of this phenomenon enables a broadening of Ricoeur’s work on religion, symbolism and identity.
